Another problem I'm having is that the CPU and Memory is always changing. Certain programs such as Firefox, Explorer, and other will change memory usage and CPU. Firefox especially will go from 00 to 17 in a couple of seconds for no reason.
I would assume that this is a viral program, but other than that I'm not sure what else to do. I have purchased Windows 7 and am also wondering if loading that will clear this issue up.

I don't suspect it to be viral, but if you really are suspicious of it being viral, download the free version of MalwareBytes, update it, then run a full scan, if it doesn't pick anything up, it's almost certainly not viral.
As you mentioned, it is an older laptop, so you can only expect the CPU and RAM to be used more, as they are probably slower and therefore have to take longer do everything.
If I'm honest, I think this is just normal. All I can suggest is try the HDD in a more powerful PC (make sure anything with personal data is not attached at the time) and see what the usage is like then.
